Terms of Service

1. Acceptance of Terms

By accessing or using the Service, or by clicking to accept these Terms, you agree to be bound by them and by our Privacy Policy, which is incorporated by reference. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to both you and that organization.

If you do not agree to these Terms, you must not access or use the Service.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service you represent and warrant that you meet this requirement and that you are legally able to enter into a binding contract.

You may not use the Service if you are barred from doing so under any applicable laws, or if your access has been previously suspended or terminated by us.

3. Description of the Service

Aryan Aijaz provides tools that use artificial intelligence to help users analyze product photographs, generate marketplace listings, estimate pricing, and prepare content for third-party e-commerce platforms.

The Service is currently offered as a free beta. Features may be added, changed, limited, or removed at any time as we develop the product, and the Service may contain errors or be interrupted.

4. User Accounts and Security

To use most features you must create an account. You agree to provide accurate and complete information and to keep it up to date.

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use. We are not liable for any loss arising from your failure to protect your credentials.

• •You may not create an account using another person's identity or information.
• •You are responsible for maintaining the confidentiality of your password.

5. Acceptable Use Policy

You agree not to misuse the Service. Without limiting the foregoing, you agree that you will not:

• •Use the Service for any unlawful, fraudulent, or deceptive purpose, including creating listings for counterfeit, stolen, prohibited, or misrepresented goods;
• •Upload content that infringes the intellectual property, privacy, or other rights of any third party;
• •Upload images or content that are unlawful, defamatory, obscene, hateful, or that depict or exploit minors;
• •Attempt to reverse engineer, decompile, scrape, or gain unauthorized access to the Service or its underlying systems;
• •Interfere with, disrupt, or place undue load on the Service, including through automated or bulk requests beyond permitted limits;
• •Circumvent usage limits, rate limits, security features, or access controls;
• •Use the Service to build or train a competing product or machine-learning model;
• •Resell, sublicense, or commercially exploit the Service except as expressly permitted.

We may investigate and take appropriate action, including suspending or terminating accounts, for any violation of this policy.

6. User Content and License

"User Content" means any images, text, product data, or other material you upload to or generate through the Service. As between you and us, you retain all ownership rights in your User Content.

You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate these Terms or any law or third-party right.

You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and transmit your User Content solely as necessary to operate, provide, secure, and improve the Service — including transmitting it to the third-party AI providers that power the Service. This license ends when you delete your User Content or your account, except where retention is required by law or for legitimate backup purposes.

7. AI-Generated Content and Disclaimers

The Service uses artificial intelligence, including third-party AI models, to analyze inputs and generate outputs such as product descriptions, categorizations, and pricing estimates ("AI Output").

AI Output is generated automatically and may be inaccurate, incomplete, outdated, or unsuitable for your particular use. It is provided for your assistance only and does not constitute professional, legal, financial, or appraisal advice.

• •You are solely responsible for reviewing, editing, and verifying all AI Output before relying on or publishing it.
• •Pricing estimates and sell-through predictions are illustrative only and are not guarantees of value, sales, or outcomes.
• •You are responsible for ensuring any content you publish complies with the policies of the marketplace where you list it (for example Amazon, eBay, Etsy, Shopify, Poshmark, or Facebook Marketplace) and with all applicable laws.
• •Similar or identical AI Output may be generated for other users; we do not guarantee that AI Output is unique.

To the extent permitted by law, you own the AI Output you generate from your own inputs, subject to these Terms and the terms of the underlying AI providers. We make no warranty that AI Output is free of third-party rights.

8. Intellectual Property

The Service, including its software, design, text, graphics, logos, and trademarks (but excluding User Content and AI Output), is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose, subject to these Terms.

You may not use our name, logo, or trademarks without our prior written permission. All rights not expressly granted are reserved.

9. Third-Party Services and Marketplaces

The Service integrates with or relies on third-party services, including AI providers, cloud infrastructure, and payment processors, and helps you prepare content for third-party marketplaces. We do not control and are not responsible for these third parties, their availability, or their terms and policies.

Your use of any third-party service or marketplace is governed by that party's own terms, and you are responsible for complying with them.

10. Payments, Billing, Subscriptions, and Refunds

The Service is currently provided free of charge during its beta period. We reserve the right to introduce paid plans, subscriptions, or usage-based fees in the future.

If we introduce paid features, we will present the applicable pricing and billing terms before you incur any charge, and your continued use of a paid feature will constitute acceptance of those terms. Unless required by law or expressly stated otherwise, fees are non-refundable. We may change pricing on a prospective basis with reasonable notice.

11. Beta Services

The Service is a beta offering and is provided "as is" and "as available". It may contain bugs, errors, and incomplete features, and may change or be discontinued at any time. We may impose usage limits, and we do not guarantee that any data, settings, or content will be preserved. You use the beta at your own risk.

12. Privacy and Data Collection

Our collection and use of personal information in connection with the Service is described in our Privacy Policy. By using the Service, you consent to the practices described there. Please review it to understand how we handle your data.

13. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL AI OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY.

We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that any AI Output will be accurate or reliable. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE OR ANY AI OUTPUT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100). Because the Service is currently free, this amount may be USD $100.

15. Indemnification

You agree to indemnify, defend, and hold harmless us and our affiliates, officers, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms or any law; or (d) your infringement of any third-party right.

16. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, if required by law, or to protect the Service or other users.

Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as by posting a notice in the Service or updating the "Last updated" date. Changes take effect when posted unless stated otherwise. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

18. Governing Law and Disputes

These Terms and any dispute arising out of or relating to them or the Service are governed by Dubai, UAE, without regard to its conflict-of-laws rules. You agree that the courts located in that jurisdiction will have exclusive jurisdiction, except where prohibited by applicable law.

Before filing any claim, you agree to first contact us to seek an informal resolution.

19. Miscellaneous

• •Entire Agreement: These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
• •Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• •No Waiver: Our failure to enforce any right or provision is not a waiver of it.
• •Assignment: You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
• •Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control.
